Waterford - Circuit Court - Civil & Family Law matters - Update re March 2021

Due to the current provisions of the Health Act 1947 (Section 31A -Temporary Restrictions) (Covid-19) Regulations 2020, the following is the situation regarding Circuit Court and County Registrar’s business: -.

1. Family Law

Family Law matters listed from 1st March 2021 to 26th March 2021are adjourned to a date to be fixed in the Circuit Court Office.
Family Law matters may be listed for hearing remotely, if possible.
A Judge will be available to hear all urgent applications.

2. Civil matters

a) Personal Insolvency matters will continue to be listed and all applications and hearings will be heard remotely.
b) Civil matters listed from 1st March 2021 to 26th March 2021 are adjourned to a date to be fixed in the Circuit Court Office and new hearing dates will be published on the Legal Diary in due course.

A Judge will be available to rule settlements, infant settlements and take applications.

Urgent applications to be heard remotely where appropriate.

A Judge will be available to hear all urgent applications.

The situation will be reviewed on a weekly basis from 15th March 2021.

WATERFORD CIRCUIT CIVIL , FAMILY LAW AND MOTION  COURTS

The Waterford Family Law Callover scheduled for March 8th 2021 will now take place on Monday April 19th 2021
The Dungarvan Callover scheduled for March 15th 2021 will now take place on Monday May 10th 2021
The Waterford Civil Callover scheduled for March 25th 2021 will now take place on Monday May 17th 2021
There will be no County Registrar's Motion Courts in the month of March. March 22nd which was the adjourned date for February Motions now stands adjourned to Monday May 10th 2021.

Notices will be published on the Courts Service website www.courts.ie in due course regarding any change in dates. Parties should consult the website for all updates and Notices. No other notice will be given.

Further, as per the Order of the President of the Circuit Court dated the 6th April 2020, where cases are settled and require to be struck out or other consent orders need to be ruled, during the current restrictions, these will continue to be dealt with by email requests from both parties and will be ruled by the County Registrar without the necessity of parties being present in court.

To apply for a ruling/order on consent, one single email ONLY from the moving party which must contain all of the following: -

(a) the correct details of the case and correct record number;
(b) the exact terms of the order sought to be made/ruled on consent;
(c)the written consent of the solicitor for the other party to the making of the consent order;
(d) a copy of the relevant Notice of Motion/ Notice of Trial;
(e) where necessary the relevant exhibits ONLY;
(f) the date the matter is listed before the Court or confirmation nothing listed for hearing.
(g) if a matter is urgent this must be highlighted by the Applicant in the subject line of the email.      All such applications should be accompanied by a sworn affidavit.

If this is not followed the email will not be acted upon and will not be replied to. Other emails sent incorrectly to the consent email address will not be replied to.

The County Registrar for Waterford will be available to hear urgent matters. Urgent matters should be e-mailed to waterfordcourtoffice@courts.ie
